1. Scope
These Terms of Sale govern the purchase and use of any Moodle plugin (“the Plugin”) sold by Pimenko (“the Provider”) through the Moodle Marketplace. By purchasing a Plugin, the customer (“the Customer”) agrees to these Terms in full.
These Terms apply exclusively to professional customers (B2B). The Plugins are not intended for sale to consumers acting in a personal capacity.
2. License Grant
Upon purchase, Pimenko grants the Customer a non-exclusive, non-transferable, limited license to install and use the Plugin on a single Moodle instance, unless otherwise specified in the Plugin’s listing.
The license is granted for the duration of the active subscription. It terminates automatically upon cancellation or non-renewal.
The Customer may not:
- Redistribute, resell, sublicense or share the Plugin with third parties
- Modify, decompile or reverse-engineer the Plugin
- Remove or alter any copyright or proprietary notices
All Plugins are distributed in accordance with Moodle’s open source licensing requirements. Commercial restrictions apply only to the subscription service, support, and updates provided under these Terms.
3. Pricing and Billing
Prices are displayed in US dollars (USD) on the Moodle Marketplace and vary per Plugin as specified in each Plugin’s listing.
Pimenko offers the following billing types depending on the Plugin:
- Recurring Monthly — billed every month
- Recurring Yearly — billed once per year
Prices are exclusive of applicable taxes. The Customer is responsible for any taxes applicable in their jurisdiction.
Payments are processed by Stripe on behalf of Pimenko. By purchasing, the Customer agrees to Stripe’s Terms of Service.
4. Subscription, Renewal and Cancellation
Subscriptions renew automatically at the end of each billing period unless cancelled by the Customer before the renewal date.
The Customer may cancel their subscription at any time through their Moodle Marketplace account. Cancellation takes effect at the end of the current billing period. Access to the Plugin remains active until that date.
Pimenko reserves the right to modify subscription pricing with a minimum of 30 days’ prior notice. Continued use after the notice period constitutes acceptance of the new pricing.
5. Refund Policy
Given the digital and immediately accessible nature of the Plugins, no refunds are granted after a billing period has commenced, except in the following cases:
- The Plugin fails to function due to a defect attributable solely to Pimenko, and Pimenko is unable to remedy the issue within a reasonable timeframe
- The purchase was made in error within 48 hours and the Plugin has not been installed or activated
Refund requests must be submitted via the issue tracker (see Section 6) within the applicable timeframe.
6. Support
Support for all Plugins is provided exclusively via Pimenko’s issue tracker. Customers with an active subscription are entitled to submit bug reports and support requests.
Pimenko commits to:
- Acknowledging support requests within 5 business days
- Providing updates compatible with Moodle LTS (Long Term Support) versions
Pimenko will make reasonable efforts to investigate and address reported issues. However, no commitment is made regarding resolution timelines or development schedules, which may vary depending on the nature and complexity of the request.
Support covers installation issues, functional bugs, and Moodle version compatibility. It does not include custom development, configuration beyond standard use, or issues arising from third-party plugins or customer-side modifications.
7. Updates
Active subscribers receive all updates released during their subscription period, including:
- Bug fixes
- Security patches
- Compatibility updates for Moodle LTS versions
Updates are not guaranteed for non-LTS or end-of-life Moodle versions.
8. Intellectual Property
All Plugins, including their code, design, and documentation, are the intellectual property of Pimenko, except where distributed under open source licenses as stated in Section 2.
The Customer acquires no intellectual property rights through the purchase of a subscription. All rights not expressly granted are reserved by Pimenko.
9. Limitation of Liability
The Plugins are provided “as is.” Pimenko does not warrant that any Plugin will be uninterrupted, error-free, or compatible with all third-party configurations.
To the maximum extent permitted by applicable law, Pimenko’s liability is limited to the amount paid by the Customer during the 12 months preceding the claim. Pimenko shall not be liable for any indirect, incidental, or consequential damages.
10. Personal Data
Personal data collected in connection with a purchase (name, email address, billing information) is processed by Pimenko as data controller, for the purposes of order management, invoicing, and customer support.
Data is processed in accordance with the General Data Protection Regulation (GDPR) and French data protection law (Loi Informatique et Libertés).
Customers have the right to access, rectify, delete, and port their personal data by contacting us.
11. Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lyon, France, unless mandatory provisions require otherwise.
12. Updates to These Terms
Pimenko reserves the right to update these Terms at any time. Customers will be notified of material changes. Continued use of any Plugin after notification constitutes acceptance of the updated Terms.
